Here’s my complicated situation. 12-19-2010 I got a ticket for expired registration in Citrus Heights, California. The cop that pulled me over didn’t tell me that I had a court date to appear at that was scheduled for 3-1-11 and I didn’t want to look at the ticket because I knew I couldn’t pay for it/fix it. I was also in the process of moving back to Lodi (a few cities over), so I didn’t get the confirmation paperwork in the mail. Eventually, my dad agreed that he would pay for the fine as a Christmas present. We first went to AAA to pay off the late registration, which was $1000+ and they told us we still needed to take care of the ticket, which was in another city. He sent me with a blank check to Citrus Heights PD and when I showed up there, they said that no such ticket existed and that I should go to the Sacramento Superior Court to make sure. When I arrived there, they told me it was my lucky day and I wasn’t in the system. I told them there was no such thing as luck, and I had an official of the court sign a paper stating that I came in with a blank check and I wasn’t in the system. I periodically checked back to see if anything had changed and it didn’t. Life goes on for 3 years. A lot of shit happened in those 3 years. For one, my father passed away suddenly from Pancreatic Cancer and at the time, he had been paying my insurance, so I knew I had to get insurance on my own.
I found a broker and I was about to reinstate my insurance for a renewal of my registration in October of 2013 when GEICO told me that my license was suspended. I was shocked and told the guy that it had to be wrong, but he told me to contact my local DMV and told me it was regarding an incident that happened in December of 2010. Confused, I went to the DMV and they printed out a shitty little piece of paper that said my license had been suspended in October (conveniently the same day I got a quote from Geico) of 2013 due to a failure to appear from a ticket that happened in 2010! WAIT A SECOND! A FAILURE TO APPEAR?! I decided to check the Sacramento Superior Court online and there it was… a ticket for $915 for a failure to appear that I was convicted of on 3-23-11.
So I remembered that I had a document provided by the court stating that I wasn’t in the system. I checked the date and it was dated 11-08-11. SIX MONTHS AFTER MY SUPPOSED CONVICTION DATE!!!
So wait a second… I came in to pay my ticket, thinking it would just be a ticket, and they tell me that I’m not in the system… and this was SIX MONTHS AFTER THEY HAD JUST CONVICTED ME OF A FAILURE TO APPEAR?! How the fuck did they convict me if the ticket didn’t exist?!
None of this shit makes any sense…
So, once again, I go to the Sacramento Superior Courts to figure out what the fuck is going on and they completely shut me out (despite me HAVING A COURT SIGNED DOCUMENT) and send me to collections (which is conveniently located IN THE COURTHOUSE). I was PLEADING my case to them and when I knew I wasn’t going to be listened to, I asked them, at the very least, to let me pay off the fine in monthly payments. They refused. Told me that too much time had passed and it’s on the second tier of collections. I HAD JUST FOUND OUT ABOUT THIS A FEW DAYS PRIOR AND TRIED TO TAKE CARE OF IT 3 FUCKING YEARS AGO!! Needless to say, I was not only in tears and felt hopeless, I had given up on the system.
Then I flipped on the local news.
There’s a bit they do called “Call kurtis” that came on. Kurtis Ming is a newscaster that takes cases from normal people regarding businesses that try to fuck over their customers. I found this situation quite fitting and decided, “fuck it. I have nothing to lose.”
This guy (Kurtis Ming) messaged me back THE NEXT DAY saying he would take on the case. the newscaster, writes me an email with the words, “This case is ugly. I’ve forwarded it to the DMV and the courts to see if they can help. Please let me know if you hear anything.”
Before, nobody would even listen to me, much less TALK to me, but with the threat of media backlash, he got me a few phone calls to some very important people.
The first phone call I received was from the head of California’s DMV. She was faxed all the paperwork and told me that she thinks it’s absolutely ridiculous what the Sacramento Courts are doing to me. She wiped my record clean for me because she felt bad that they were doing this to me. She told me that the Sacramento Superior Court still won’t budge on the case, but if I waited until 2015 (the five year mark), I could get my license back and it would be off my record.
Now there’s a little light at the end of the tunnel, but I wasn’t going to give up so easy with the court…
Kurtis Ming then got me a phone call to the head of the traffic court of Sac Superior Courts. I was thrilled since NOBODY would listen to a fucking word I was saying, much less LOOK at the evidence I had!
So I talked with this lady who was FUCKING HARD TO GET AHOLD OF. She told me that it was an obvious mistake and that I would just have to pay the ticket fine, which was $350. She would just have to get it okay’ed with the judge and then it would be just the original ticket price. That was fine by me, but I had asked her how I was able to get the car registered no problems for two years after the conviction date and why my license was suspended three years later. No answer.
Then the call happened…
She told me that the judge had found no fault of theirs and that I had received another ticket for the infraction (that was conveniently THROWN OUT!) and that ticket was from Citrus Heights PD and the ticket that’s outstanding was from CHP and I must have looked up the wrong ticket so the $915 in full still stands!!!
ARE YOU FUCKING KIDDING ME?!!?!?!? I gave the courts MY NAME, not a fucking CITATION NUMBER!!!
To make things worse, Kurtis Ming, tells me that there’s nothing more he can do and wishes me luck. A sign that I’m royally fucked…
So here I sit… it’s February 16, 2015 and my license is still suspended and my car is on non-op, collecting dust and (I’m sure) needs a new battery. At the end of the year, I’ll be able to reinstate my license. I still owe $915 in full, but oddly enough, it’s not on my credit report so they can go fuck themselves,
Why you ask?
…because if it’s not on my credit report,
IT’S NOT IN THE SYSTEM!
